The commercial functions of a trade mark, unconventional trade marks and modern technology
The paper analyses the current legislation within the UK and Europe with respect to trade mark law. A number of legal journals and case reports provide the bulk of research material, with use of direct judicial quotes and key opinions of journal authors providing the framework for research into the state of current trade mark law. The historical functions of trade marks dating back nearly a century are still relevant today, with concepts recognised and enshrined by both domestic UK and European Union courts. Trade marks work as a badge of origin and, by extension, allow similar products to be differentiated. They act as a guarantee of quality and an ambassador for the generation and preservation of goodwill that has been generated within a given trade mark. Gaining a trade mark confers a near monopoly on its use and the legislation provides mechanisms to protect and recognise this. A trade mark allows businesses to build identity, quality and reputation into the core essence and branding of their products. A diverse quantity of ideas and concepts are capable of representation graphically, in both conventional and abstract forms, allowing them to be trade marked. The resulting monopoly granted by the trade mark is of exceptional importance to businesses of all sizes, allowing them to benefit from the breadth of commercial functions that a trade mark can fulfil. Despite the law regularly playing catch-up to new technological advances, the courts are applying flexible and practical solutions to accommodate the developing needs of modern informational technology
Bio-GO-SHIP: The Time is Right to Establish Global Repeat Sections of Ocean Biology
In this article, we present Bio-GO-SHIP, a new ocean observing program that will incorporate sustained and consistent global biological ocean observations into the Global Ocean Ship-based Hydrographic Investigations Program (GO-SHIP). The goal of Bio-GO-SHIP is to produce systematic and consistent biological observations during global ocean repeat hydrographic surveys, with a particular focus on the planktonic ecosystem. Ocean plankton are an essential component of the earth climate system, form the base of the oceanic food web and thereby play an important role in influencing food security and contributing to the Blue Economy. Despite its importance, ocean biology is largely under-sampled in time and space compared to physical and chemical properties. This lack of information hampers our ability to understand the role of plankton in regulating biogeochemical processes and fueling higher trophic levels, now and in future ocean conditions. Traditionally, many of the methods used to quantify biological and ecosystem essential ocean variables (EOVs), measures that provide valuable information on the ecosystem, have been expensive and labor- and time-intensive, limiting their large-scale deployment. In the last two decades, new technologies have been developed and matured, making it possible to greatly expand our biological ocean observing capacity. These technologies, including cell imaging, bio-optical sensors and \u27omic tools, can be combined to provide overlapping measurements of key biological and ecosystem EOVs. New developments in data management and open sharing can facilitate meaningful synthesis and integration with concurrent physical and chemical data. Here we outline how Bio-GO-SHIP leverages these technological advances to greatly expand our knowledge and understanding of the constituents and function of the global ocean plankton ecosystem
Measurements of |Vub| and |Vcb| from CLEO
I report results from the CLEO collaboration on semileptonic B decays,
highlighting measurements of the Cabibbo-Kobayashi-Maskawa matrix elements
|Vub| and |Vcb|. I describe the techniques used to obtain the recent
improvements in precision for these measurements, notably the use of the b -> s
gamma photon spectrum to constrain non-perturbative hadronic effects in

Hadronic Spectral Moments in Semileptonic B Decays With a Lepton Energy Cut
We compute the first two moments of the final hadronic invariant mass in
inclusive semileptonic B decay, in the presence of a cut on the charged lepton
energy. These moments may be measured directly by experiments at the
Upsilon(4S) using the neutrino reconstruction technique, which requires such a
cut. Measurement of these moments will place constraints on the nonperturbative
parameters \bar\Lambda and \lambda_1, which are relevant for extracting the
quark masses m_b and m_c, as well as the CKM angle V_cb. We include terms of
order \alpha_s^2\beta_0 and 1/m_b^3 in the operator product expansion, and use
the latter to estimate the theoretical uncertainty in the extraction of
\bar\Lambda and \lambda_1.Comment: 13 pages, 5 figures, REVTe
Hadron Spectra for Semileptonic Heavy Quark Decay
We calculate the leading perturbative and power corrections to the hadronic
invariant mass and energy spectra in semileptonic heavy hadron decays. We apply
our results to the system. Moments of the invariant mass spectrum, which
vanish in the parton model, probe gluon bremsstrahlung and nonperturbative
effects. Combining our results with recent data on meson branching ratios,
we obtain a lower bound and an upper bound
GeV. The Brodsky-Lepage-Mackenzie scale setting
procedure suggests that higher order perturbative corrections are small for

The languages of Malta
The purpose of this volume is to present a snapshot of the state of the art of research on the languages of the Maltese islands, which include spoken Maltese, Maltese English and Maltese Sign Language.
Malta is a tiny, but densely populated country, with over 422,000 inhabitants spread over only 316 square kilometers. It is a bilingual country, with Maltese and English enjoying the status of official languages. Maltese is a descendant of Arabic, but due to the history of the island, it has borrowed extensively from Sicilian, Italian and English. Furthermore, local dialects still coexist alongside the official standard language. The status of English as a second language dates back to British colonial rule, and just as in other former British colonies, a characteristic Maltese variety of English has developed. To these languages must be added Maltese Sign Language, which is the language of the Maltese Deaf community. This was recently recognised as Malta’s third official language by an act of Parliament in 2016.
While a volume such as the present one can hardly do justice to all aspects of a diverse and complex linguistic situation, even in a small community like that of Malta, our aim in editing this book was to shed light on the main strands of research being undertaken in the Maltese linguistic context.
Six of the contributions in this book focus on Maltese and explore a broad range of topics including: historical changes in the Maltese sound system; syllabification strategies; the interaction of prosody and gesture; the constraints regulating /t/-insertion; the productivity of derivational suffixes; and raising phenomena. The study of Maltese English, especially with the purpose of establishing the defining characteristics of this variety of English, is a relatively new area of research. Three of the papers in this volume deal with Maltese English, which is explored from the different perspectives of rhythm, the syntax of nominal phrases, and lexical choice. The last contribution discusses the way in which Maltese Sign Language (LSM) has evolved alongside developments in LSM research.
In summary, we believe the present volume has the potential to present a unique snapshot of a complex linguistic situation in a geographically restricted area. Given the nature and range of topics proposed, the volume will likely be of interest to researchers in both theoretical and comparative linguistics, as well as those working with experimental and corpus-based methodologies. Our hope is that the studies presented here will also serve to pave the way for further research on the languages of Malta, encouraging researchers to also take new directions, including the exploration of variation and sociolinguistic factors which, while often raised as explanatory constructs in the papers presented here, remain under-researched
